Father fined after toddler dies in Cyprus hotel fall
Ninoda.com – A father from Essex has been fined €3,000 (£2,500) after his two-year-old son died following a fall from a fourth-floor hotel window in Cyprus.
Joshua Foster, 37, admitted causing his son’s death through a reckless, rash or dangerous act. Paphos District Court imposed the fine on Friday, following the tragedy at the King Evelthon Beach Hotel and Resort in Chlorakas on 12 July.
The child fell almost 40ft, or 12.1m, on the first day of a family holiday. Foster had arrived in Cyprus only hours earlier with his wife, their two children and his in-laws. The family had spent time swimming and taking part in holiday activities before returning to get ready for dinner.
Moment at hotel lift
The incident occurred at about 18:00 as Foster, his father-in-law and his son were heading towards an elevator. His lawyer, Alexandros Alexandrou, told the court that Foster had been playing with the boy when they approached the lift area.
The toddler noticed a waterpark outside. Foster pressed the lift button and placed his son on the windowsill so he could see the view. He believed the window was shut, but the child fell before he was able to hold him.
In a voluntary statement given to police, Foster said his son “fell before he had a chance to grab him”. The court heard that the window measured 2.85m (9.3ft) across and 1.2m (3.9ft) high.
Emergency services were called at about 18:40 after reports that a child had fallen in unclear circumstances. The boy was taken to Paphos General Hospital, where he was later pronounced dead.
Eight days in custody
Foster was detained for eight days in the immediate aftermath of the incident. During that time, Mr Alexandrou said, he had to telephone his daughter from custody and explain what had happened to her brother.
The lawyer said the events of that evening had permanently altered his client’s life. At an earlier hearing on 6 October, he described the moment as “inconceivable” and said Foster had shown clear remorse.
Alcohol was found in Foster’s system, but it was not a major part of the prosecution case. Mr Alexandrou said there was no evidence that Foster had been drunk at the time of the fall.
“Thank you for the support. I’m looking forward to going home and being with my wife and daughter.”
Foster made the brief statement to reporters after the sentencing.
Family seeks time to grieve
Outside the court, Mr Alexandrou called Foster an “incredible father” and an exemplary family man supported by relatives who had remained close throughout the case.
“[He is] an exemplary family man with a beautiful family behind him, that support him, that embraces him, that has always been by his side.”
Mr Alexandrou said Foster was deeply emotional after the sentence and that the family now needed space to grieve. He said they had spent the legal process in a defensive position while dealing with the loss of a child.
“They have been in a defence mode during this procedure.”
The case highlights the devastating consequences that can follow in only a few seconds around windows, balconies and other elevated areas. Hotels and holiday accommodation can contain unfamiliar layouts, large glass panels and openable windows, making close supervision of young children especially important even during ordinary family moments.
For Foster and his family, the court proceedings concluded with a financial penalty, but the emotional impact of the death of their young son remains far beyond any sentence. The family had travelled to Cyprus for a holiday together; within hours, it had become a tragedy that will shape their lives permanently.
